By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

5. Account Registration and Security

6. Subscriptions and Billing

6.2 Free Trial

New users may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled.

6.3 Billing

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

6.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of your billing period.

7. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service

8. Market Data and Third-Party Services

8.1 Market Data

Market data displayed on the Service is provided by third-party data providers including Massive.com (formerly Polygon.io). This data is licensed for display-only use. You may not redistribute, retransmit, or use the data for automated trading systems, algorithmic decision-making, or any non-display purpose without proper licensing.

8.2 Broker Integration

When connecting to third-party brokers (such as Alpaca), you are also subject to their terms of service and privacy policies. Tradiomatic is not responsible for the actions, services, or policies of third-party brokers. Brokerage services are provided by the respective broker, not by Tradiomatic.

8.3 Data Accuracy

While we strive to provide accurate market data, we do not guarantee the accuracy, completeness, or timeliness of any data. You acknowledge that data may be delayed, interrupted, or contain errors.

9. Intellectual Property

The Service, including all content, features, and functionality, is owned by Tradiomatic and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any strategies, layouts, or content you create using the Service, but grant us a license to store and display such content as necessary to provide the Service.

10. Limitation of Liability

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Tradiomatic, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

14. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Arbitration

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
